2005 Legislative Updates!
Due to the steadfast efforts of the Florida DMV, some long awaited
changes to Florida’s vehicle laws took effect July 1, 2005
via HB 1697 (2005). For the most part, those of us in parking
enforcement or law enforcement will benefit significantly as a
result. In short, these changes are directed at problems with
identifying vehicle owners or operators who park illegally or
improperly, who create hazardous parking situations, who fail
to pay for parking on-street and off-street, who use our garages
for storage, and who inconvenience our disabled population by
parking in designated disabled spaces without a permit.
So, why is there a problem with identification? As it is related
to the legislative changes noted below, ongoing identification
problems stem from temporary tags, lease vehicles, and transfer
of ownership that is not processed through DMV records, such as
with trade-in and auctioned vehicles.
In any case, identifying these violators is the key. Once identified,
owners and operators can be alerted of improper conduct, fined
as a consequence, and notified of any pending scofflaw status.
And, our governmental as well as private entities can improve
revenues and infrastructure, and therefore enhance public safety
and provide a more positive parking experience overall.

Below are the highlights of the aforementioned legislative changes:
F.S. 320.0601
Registration of a long-term leased motor vehicle
must be in the name and address of the lessee.
F.S. 320.131(6)
Every licensee shall keep a book or record for a period of
5 years of the purchase, sale, or exchange, or receipt for
the purpose of sale, of any motor vehicle.
F.S. 320.131(8)
The Department of Motor Vehicles may administer an electronic
system for issuing temporary license plates. Once the system is
in place, a vehicle dealer shall enter the vehicle and owner
information in the system when issuing a temporary license
plate.
F.S. 320.27(6)
A dealer who acquires a trade-in vehicle must file a
notice of sale signed by the seller.
